SHORT TERM RENTAL AGREEMENT

 

This Short-Term Rental Agreement (the "Agreement") is made by and between Gulfside Beach Club Homeowners Association ("Owner") and [Guest Name] ("Guest") as of the date last set forth on the date of your booking with Gulfside Beach Club Homeowners Association. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

 

  1. 1. Property. The property is located at 427 Casey Key Road, Nokomis, FL. The property is furnished and includes all appliances, linens, towels, equipped kitchen, and furnishings. These items are not to be removed from the property and are to be left in as good a condition as they were upon arrival. Appliances are to be used only for their intended uses.
  2. 2. Rental Guest(s). Unit rates are for 2 people. Additional guests are charged $20/person/night; additional linens will be provided. Rates are subject to Florida taxes. The primary Guest signing this agreement must be at least 25 years old and be present throughout the entire reservation period (copy of a valid photo ID is required). The number of guests sleeping at your rental is not to exceed the number in the property listing. There are to be no on-site parties or events held on the property during the reservation period. We ask that you be respectful of other guests and follow the noise guidelines set by the property. The primary Guest signing this agreement will be responsible for any damages to the property caused by you or those staying during your reservation.
  3. 3. Check-in / Check-out. Check-in is any time after 3:00 pm Eastern and Check-out time is no later than 10:00 am Eastern. If the Guest is not checked out by 10:00 am Eastern, this will result in an additional night’s charge.
  4. 4. Parking. Parking is limited. Guest shall park in assigned parking space, which is the same number as the unit number. Guest must advise the office of any extra vehicles, daytime visitors, or overnight guests to be given a designated space for them.
  5. 5. Owner Access. The Guest shall allow the Owner access to the property for purposes of repair and inspection. Owner shall exercise this right of access in a reasonable manner.
  6. 6. Pets. Because of HOA regulations, there are no pets allowed. Should there be any evidence (pet hair, urine stains/odor, damage to property) inside the property or on the balcony upon inspection after Guest's departure, there will be a $500 fee added to Guest's stay.
  7. 7. Smoking. There is no smoking allowed inside the property. Smoking is only permitted outside or on your porch if you are not disturbing any other guests. Should there be any evidence (ashes, burns, odor) of smoking inside the property or on the balcony upon inspection after your departure, there will be a $250 fee added to your stay.
  8. 8. Housekeeping. There is no daily housekeeping service with any of our properties. While linens and towels are provided with the rental, daily maid service is not included in the rental rate. There is a washer and a dryer in the rental for your convenience. Please do not take bathroom towels to the beach.
  9. 9. Departure Policy. Please do the following before checking out: Return any items belonging to another unit. Take all garbage and recyclables to the dumpster and recycling bins. Clean dishes and put them away or start dishwasher. Wash beach towels and extra towels the night before. Start the washer with remaining towels on the morning of departure. Leave unwashed sheets on the bed.
  10. 10. Cancellation Policy. If you need to cancel your reservation, just let us know at least 60 days before your arrival, and we'll provide a full refund. If you cancel within 60 days of your arrival, your $500 deposit will be non-refundable. If we're able to rebook your dates, we'll happily refund whatever we're able to recover from the new reservation. Booked through a different site? Be sure to check their cancellation policy, as it may be different from ours.
  11. 11. Payment. Payment can be made on the Guest Portal or on the website used to make your reservation. You may also call the onsite office to make your deposits and payments.
  12. 12. Refunds. The beaches are known for seasonal tropical storms and hurricanes. Unless our Island is under evacuation notice from local officials, there are no refunds. We suggest that you look into trip insurance for your vacation here on Casey Key. There are no refunds given for loss of utilities, HVAC malfunctions, appliance malfunctions, property amenities being unavailable or acts of God. The Owner will however, to its best ability within reason, make efforts to have malfunctions resolved as soon as possible once notified by the Guest.

 

Owner is not responsible for any accidents, injuries or illnesses that occur while on the premises or its facilities. Owner is not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises.
